1. Acceptance of these terms

By creating an account or using Build Your Book (the "Service"), you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use the Service.

The Service is operated by OrcSyn Intelligent Technologies ("we", "us", "our").

2. Account eligibility & security

• You must be at least 13 years old (16+ in EU/UK) to create an account.
• One person, one account. Provide accurate information and keep your password confidential.
• You are responsible for every activity that happens under your account. Tell us immediately if you suspect unauthorized access.
• We may suspend or close accounts that violate these Terms, our Child-Safe policies, or applicable law.

3. Content & ownership

What you create stays yours. You retain full ownership of the storybooks, illustrations, and audio you generate using the Service. By uploading or generating content you grant us a worldwide, royalty-free, non-exclusive licence to host, display, distribute, and (with your consent) feature your content on the Marketplace and in promotional material — solely for the purpose of operating and promoting the Service.

• You warrant that you own the rights to any character names, real-life likenesses, or third-party material you submit.
• AI-assisted content is generated by Google Gemini and OpenAI under their respective terms — we pass through the broad commercial use rights they grant.
• The Build Your Book name, logo, codebase, and curated assets are our intellectual property and may not be reused without written permission.

4. Acceptable use

You agree not to use the Service to:

• Create or publish content unsuitable for children, including sexual, hateful, violent, drug-related, or self-harm material.
• Impersonate another person, infringe copyright, or upload deepfakes without consent.
• Reverse-engineer, scrape, or attempt to extract source code or AI prompts.
• Circumvent moderation, paywalls, rate limits, or subscription quotas.
• Send spam, phishing, malware, or any abusive automated traffic.

Violations result in content removal, account suspension, refund forfeiture (where allowed by law), and where appropriate, referral to law enforcement.

5. Subscriptions, marketplace purchases & payments

• Razorpay is our sole payment gateway. Indian users are charged in INR; international users in USD, based on IP geolocation.
• Subscription validity is days-based (not calendar months) and starts the moment payment clears.
• Marketplace storybooks are sold per-book; once unlocked, they remain in your Library as long as your account is active.
• Prices and quotas are subject to change. Changes apply to renewals only — never to plans you have already paid for.
• Bespoke "Legendary" plans are quoted individually and governed by the same Terms.

6. Refunds & cancellation

• You may cancel a subscription at any time from Settings. Cancellation stops future renewals; the current term continues until expiry.
• Refunds for subscriptions are available within 7 days of payment only if you have not consumed any of the bundled book credits.
• Marketplace book purchases are final — because you receive instant access to the full book — except where the book is later removed for safety reasons, in which case we refund automatically.
• Refunds are returned to the original payment method within 5–10 business days via Razorpay.
• Gift purchases are refundable to the buyer until the recipient redeems them.

7. Service availability

We aim for high uptime but the Service is provided "as is" — no warranty of uninterrupted availability. We will give reasonable notice of planned maintenance whenever possible. Generative AI features depend on third-party providers (Google Gemini, OpenAI); rare provider outages may briefly disable new creation while existing content remains accessible.

8. Limitation of liability

To the maximum extent permitted by applicable law, our aggregate liability for any claim arising from your use of the Service is limited to the amount you paid us in the 12 months immediately preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, lost profits, or lost data — except where liability cannot be excluded under consumer-protection law.

9. Governing law & disputes

These Terms are governed by the laws of India. Any dispute will first be addressed via good-faith email correspondence. Unresolved disputes will be submitted to the exclusive jurisdiction of the courts of Ahmedabad, Gujarat, India.

10. Changes to these terms

We may amend these Terms from time to time. For material changes, we will email all active users at least 14 days before the new Terms take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
